谷驰智能床垫 APP 是由谷驰智能床垫(深圳市露美家具有限公司)（以下简称“我们”或“谷驰”）为您提供的用于智能睡眠设备相关的智能家居控制、体征监测、睡眠管理、健康记录、语音助手、健康服务等的产品。

我们非常重视您的隐私和个人信息。本隐私政策与您所使用的我们的产品与/或服务息息相关，您在下载、安装、启动、浏览、注册、登录、使用我们的产品与/或服务（以下统称“使用我们的产品与/或服务”）时，我们将按照本隐私政策的约定处理和保护您的个人信息，因此我们希望您能够仔细阅读、充分理解本隐私政策的全文，并在需要时，按照本隐私政策的指引，作出您认为适当的选择。本隐私政策之中涉及的相关技术词汇，我们尽量以简明扼要的表述向您解释，以便于您理解。

One Smart Sleep App is a product provided by Guchi (Suzhou Guchi Intelligent Technology Co., Ltd.) (hereinafter referred to as "we" or "Guchi") for smart home control related to intelligent sleep devices, physical sign monitoring, sleep management, health record-keeping, voice assistant services, health services, and more.

We attach great importance to your privacy and personal information. This Privacy Policy is closely related to the products and/or services you use. When you download, install, launch, browse, register, log in to, or use our products and/or services (collectively referred to as "using our products and/or services" hereinafter), we will process and protect your personal information in accordance with the provisions of this Privacy Policy. Therefore, we hope you can carefully read and fully understand the entire content of this Privacy Policy, and when necessary, make appropriate choices as guided by this Privacy Policy. For relevant technical terms involved in this Privacy Policy, we will try to explain them to you in concise terms to facilitate your understanding.

本隐私政策为我们的所有产品与/或服务统一适用的通用内容，当您使用我们的任何产品与/或服务时，本隐私政策即适用，无论该产品与/或服务是否单独设置了隐私条款，也无论您是浏览用户（访客）还是注册登录用户。但请您注意，本隐私政策不适用于以下情况：我们的产品与/或服务可能会包含或链接至第三方提供的信息与/或第三方服务（包括任何第三方应用、网站、产品、服务等），这些信息与/或服务由第三方负责运营，您使用该等信息与/或服务与我们无关。本隐私政策仅适用于我们所收集的您的个人信息，并不适用于任何第三方对您的个人信息的收集，以及任何第三方提供的服务或第三方的信息使用规则，我们对任何第三方收集、储存和使用您个人信息的行为在法律允许的范围内亦不承担任何责任。

     1. 个人信息：指以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息，不包括匿名化处理后的信息。
     2. 敏感个人信息：指一旦泄露或者非法使用，容易导致自然人的人格尊严受到侵害或者人身、财产安全受到危害的个人信息，包括生物识别、宗教信仰、特定身份、医疗健康、金融账户、行踪轨迹等信息， 以及未满十四周岁未成年人的个人信息。
     3. 个人信息的处理：包括个人信息的收集、存储、使用、加工、传输、提供、公开、删除等。
     4. 个人信息删除：指在实现日常业务功能所涉及的系统中去除个人信息的行为，使其保持不可被检索、访问的状态。
     5. 去标识化：指通过对个人信息的技术处理，使其在不借助额外信息的情况下，无法识别或者关联个人信息主体的过程。
     6. 匿名化：指通过对个人信息进行技术处理，使得个人信息主体无法被识别，且处理后的信息不能被复原的过程。

1.Scope of Application of This Privacy Policy and Definitions of Relevant Terms

1.1 Scope of Application

This Privacy Policy is a general document applicable to all our products and/or services. It shall apply whenever you use any of our products and/or services, regardless of whether such products and/or services have separate privacy clauses, and regardless of whether you are a browsing user (visitor) or a registered/logged-in user. However, please note that this Privacy Policy does NOT apply to the following situations:

• Our products and/or services may contain or link to information and/or services provided by third parties (including any third-party apps, websites, products, services, etc.). Such information and/or services are operated by third parties, and your use of them is not related to us.
• This Privacy Policy only applies to the personal information we collect, and does not apply to the collection of your personal information by any third party, or to the service rules or information usage rules of any third party. We also assume no liability within the scope permitted by law for any act of collecting, storing, or using your personal information by third parties.

1.2 Definitions of Relevant Terms

1.2.1 Personal Information
Refers to various information recorded in electronic or other forms that is related to identified or identifiable natural persons, excluding information that has been anonymized.

1.2.2 Sensitive Personal Information
Refers to personal information that, if leaked or used illegally, may easily infringe on a natural person’s personal dignity or endanger their personal or property safety. This includes biometric information, religious beliefs, specific identities, medical health data, financial account information, tracking data, and other such information, as well as the personal information of minors under the age of 14.

1.2.3 Processing of Personal Information
Includes the collection, storage, use, processing, transmission, provision, disclosure, deletion, and other handling of personal information.

1.2.4 Deletion of Personal Information
Refers to the act of removing personal information from the systems involved in daily business functions, rendering it non-searchable and inaccessible.

1.2.5 De-identification
Refers to the process of technically processing personal information so that it cannot identify or be associated with a personal information subject without the aid of additional information.

1.2.6 Anonymization
Refers to the process of technically processing personal information so that the personal information subject cannot be identified, and the processed information cannot be restored to its original form.

1. 我们收集哪些信息以及如何使用这些信息

我们会遵循正当、合法、透明、必要的原则，出于本隐私政策所述的以下目的，收集和使用您在使用我们的产品或服务过程中主动提供或因使用我们的产品或服务而产生的个人信息。

请您注意，在您向我们提供任何个人敏感信息前，您已慎重考虑并在此确认该等提供是适当的，您在此同意您的个人敏感信息可按照本政策所述的目的和方式进行处理。您在使用我们的产品与/或服务时，我们需要/可能需要收集和使用您的个人信息类型包括如下两种： 第一种：我们提供产品与/或服务的基本功能所必需的信息：此类信息为产品与/或服务正常运行的必备信息，您须授权我们收集和使用，如您拒绝提供，您将无法正常使用我们的产品与/或服务； 第二种：我们提供产品与/或服务的附加功能所必需的信息：此信息非为产品与/或服务正常运行的必备信息，您可以选择单独同意或不同意我们收集和使用。 如您拒绝提供，您将无法正常使用相关附加功能或导致附加功能无法实现或达到我们拟达到的效果，但不影响您对基本功能的正常使用。

• 1. 账户创建服务

为了创建账户以识别和存储您的个人信息，以及向您发送您使用我们的产品与/或服务产生的相关报告，并与您联系或发送必要的通知，我们需要收集和使用您的手机号码和与您身份相对应的唯一ID信息。 如您拒绝提供，我们将无法识别用户并提供相应的产品与/或服务，也无法发送通知给您。如您选择设置密码的方式创建账户，我们会一并收集和存储（加密）您的密码。为了提供主页服务，完善您的主页信息，我们需要收集和使用您向我们提供的头像、昵称信息等信息。如您拒绝提供，可能导致该服务无法达到我们拟达到的效果。

另外，为了提供更优质的服务，我们需要处理与您的应用程序使用相关的操作记录信息（包括但不限于授权记录、产品连接与使用记录、遥控器按键记录、APP功能触发记录），如您拒绝提供，将无法使用我们的产品与/或服务。

• 1. 智能睡眠/智能家居等设备的绑定

为了支持您智能设备与App的绑定，我们会收集您的账号信息、设备的标识信息、手机设备的标识信息（IMSI、MAC 地址、MEID、Android ID、设备硬件序列号、SIM 卡标识）、手机型号、系统版本号、智能设备的蓝牙信息、设备型号。同时，我们会收集当前运行的 App 进程信息，以便确定当前 App 是否处于前台运行状态，并根据不同的进程处理相应业务。

• 1. 健康监测和睡眠日记服务

为向您提供健康监测、长期健康管理和睡眠日记服务，您需要向我们提供身高、年龄、体重等基础生物体征信息和睡前活动、身体状态信息、睡眠状态等相关信息。如您拒绝提供以上信息，您将无法使用我们的完整的健康监测和睡眠日记服务。如您不提供睡前活动和身体状态信息，可能导致该服务无法达到我们拟达到的效果，但不影响您使用该服务。

• 1. 基于传感器的服务
     1. 睡眠日报/周报/月报/小憩报告/单次报告服务

为向您提供睡眠日报/月报/初测报告/小憩报告/单次报告等服务，我们需要收集和使用您的睡眠信息（包括但不限于睡眠得分、入睡时间、 醒来时间、深睡时长、浅睡时长和清醒时长（合称睡眠时长）、睡眠效率、睡眠体动、离床时长、离床次数等），心率信息（包括但不限于睡眠时间段心率、平均心率、心率参考值、心率失常指数变化、疲劳指数、恢复指数等），呼吸信息（包括但不限于睡眠时间段呼吸率、呼吸率参考值、呼吸率均值等），打鼾信息（包括但不限于打鼾次数、减鼾次数、减鼾时间点、减鼾灵敏度等），压力信息（包括但不限于压力综合指标、抗压能力、压力指数、自主神经系统的活性）、心率变异性信息（包括但不限于HRV参考值，心血管事件高危要素指数、夜间神经系统功能输出指数、心血管事件发生风险指数、心脏自主神经功能调节受损指数等）和算法信息（呼吸暂停次数、呼吸暂停发生时间、呼吸暂停参考值），并根据上述信息为您生成睡眠报告。

• • 1. 语音控制/鼾声监测/打鼾智能干预服务

部分产品配置语音控制功能，我们需要收集您的声音信息，以此来实现智能设备的语音控制功能。鼾声监测作为鼾声干预的信息收集来源，我们需要收集您的声音、声色等信息，以此来通过鼾声算法进行鼾声的的识别和设备功能的应用。此功能为设备正常运行的必备信息，在您开始注册使用我们产品或服务时即表示同意我们进行此类信息的收集和使用。

• 1. 其他服务

为了使您基于传感器的附加服务更加准确，我们需要收集和使用您的性别、出生日期、身高、体重信息，如您拒绝提供体重信息，将无法使用我们的产品与/或服务。 如您拒绝提供性别、出生日期和身高信息，可能导致附加服务无法达到我们拟达到的效果，但不影响您对基本功能的正常使用。

• 1. 闹钟服务

为向您提供闹钟服务，我们需要处理您的闹钟设置信息、闹钟执行时间和闹钟周期时间信息，您可以通过APP的闹钟开关来决定开启或关闭闹钟服务，如您关闭闹钟开关，将无法使用我们的闹钟服务。

• 1. 云关爱服务

为向您提供云关爱服务，我们需要处理您的ID、被关爱用户ID、以及您提供的关爱人和被关爱人的手机号码、邮箱等。我们需要处理被关爱用户的前述个人信息，您应确保您已经合法取得被关爱用户的同意。若您主动选择云关爱服务，即表示您已经获得被关爱用户的同意并同意我们按本隐私政策所述目的和方式来处理被关爱用户的上述个人信息。如您拒绝提供，您将无法使用我们的云关爱服务。

• 1. 数据分析服务

为向您提供更优质的服务，我们会使用或与第三方数据服务商合作进行数据分析以预测您的特征偏好。如您不同意我们进行数据分析，您将无法享受数据分析服务以及与该服务相关联的其他服务，但不影响您使用我们的产品与其他服务。

• 1. 用户睡眠报告解读服务

为了向您提供用户睡眠报告解读服务，我们不仅需要收集和使用您上述各项具体功能场景下的部分信息，而且需要收集和使用您的设备功能的使用记录信息( 具体以您实际使用的功能为准)。如您拒绝提供上述信息，您将无法使用我们的用户睡眠报告解读服务，即我们的睡眠管家无法为您解读睡眠报告。

• 1. 基于系统权限的服务

我们在向您提供以下的产品与/或服务中会通过开启系统权限以收集和使用您的个人信息。如您不同意开启相关权限，您将无法正常使用我们的产品与/或服务。

您可在您的设备“设置”中查看上述权限的状态，并可自行决定这些权限随时的开启或关闭。

请您注意，您开启任一权限即代表您授权我们可以收集和使用相关个人信息来为您提供对应服务，您一旦关闭任一权限即代表您取消了授权，我们将不再基于对应权限继续收集和使用相关个人信息， 也无法为您提供该权限所对应的服务。

我们的应用权限申请与使用情况说明如下：

• • 1. 相机/摄像头权限：为了将您的账户与我们的智能设备绑定，您需要开启相机/摄像头权限扫描二维码，如您不开启该权限，您将无法使用我们的产品和服务。此外，若您开启相机/摄像头权限，可通过拍摄照片来完善您的个人主页信息，如您不开启该权限，不影响产品基本功能的使用，但可能导致该服务无法达到我们拟达到的效果。
    2. 网络权限：您使用我们的任一产品与/或服务，都需要使用到网络进行数据通信，如您不开启该权限，您将无法使用我们的产品和服务。
    3. 位置权限：您使用我们的任一产品与/或服务，您需要开启位置权限，如您不开启该权限，您将无法使用我们的产品和服务。
    4. 相册权限：您使用我们的任一产品与/或服务，您需要开启相册权限，如您不开启该权限，您将无法使用我们的产品和服务。
    5. 麦克风权限：您使用我们有App语音功能的产品与/或服务时，们会收集您的麦克风信息。
    6. 存储权限：为对您的产品进行升级，您需要开启存储权限来获取您产品的固件，如您不开启该权限，您将无法进行产品升级。此外，如您需要访问设备上的照片、媒体内容或文件，您需要开启存储权限。如您不开启该权限，不影响产品基本功能的使用，但可能导致该服务无法达到我们拟达到的效果。

2. What Information We Collect and How We Use It

We collect and use personal information that you actively provide or that is generated from your use of our products or services, following the principles of lawfulness, legitimacy, transparency, and necessity, and for the purposes described in this Privacy Policy.

Please note: Before providing any sensitive personal information, you should carefully consider and confirm that such provision is appropriate. By providing such information, you consent to the processing of your sensitive personal information in accordance with the purposes and methods described in this Policy. When using our products and/or services, the types of personal information we need or may need to collect and use include the following two categories:

• Category 1: Information necessary for the basic functions of our products and/or services
  This information is essential for the normal operation of our products and/or services. You must authorize us to collect and use it. If you refuse to provide it, you will not be able to use our products and/or services normally.
• Category 2: Information necessary for the additional functions of our products and/or services
  This information is not essential for the normal operation of our products and/or services. You may choose to separately consent to or refuse our collection and use of it. If you refuse to provide it, you will not be able to use the relevant additional functions normally, or the additional functions may fail to achieve the intended effects, but this will not affect your use of the basic functions.

2.1 Account Creation Services

To create an account to identify and store your personal information, send you relevant reports generated from your use of our products and/or services, and contact you or send necessary notifications, we need to collect and use your mobile phone number and unique ID information corresponding to your identity.

• If you refuse to provide this information, we will not be able to identify users, provide corresponding products and/or services, or send notifications to you.
• If you choose to create an account by setting a password, we will also collect and store (in encrypted form) your password.
• To provide homepage services and complete your homepage information, we need to collect and use avatar, nickname, and other information provided by you. If you refuse to provide this information, the service may fail to achieve the intended effects.

Additionally, to provide better services, we need to process operation record information related to your use of the app (including but not limited to authorization records, product connection and usage records, remote control button records, and app function trigger records). If you refuse to provide this information, you will not be able to use our products and/or services.

2.2 Binding of Smart Sleep/Smart Home Devices

To support the binding of your smart devices to the app, we collect:

• Account information;
• Device identification information;
• Mobile device identification information (IMSI, MAC address, MEID, Android ID, device hardware serial number, SIM card identification);
• Mobile phone model, system version number;
• Bluetooth information of smart devices;
• Device model.

We also collect information about currently running app processes to determine whether the app is in the foreground and handle corresponding services based on different processes.

2.3 Health Monitoring and Sleep Diary Services

To provide you with health monitoring, long-term health management, and sleep diary services, you need to provide basic biometric information (height, age, weight) and information related to pre-sleep activities, physical condition, sleep status, etc.

• If you refuse to provide this information, you will not be able to use our full health monitoring and sleep diary services.
• If you do not provide pre-sleep activity and physical condition information, the service may fail to achieve the intended effects, but this will not affect your use of the service.

2.4 Sensor-Based Services

2.4.1 Sleep Daily/Weekly/Monthly Reports, Nap Reports, Single Session Reports

To provide sleep reports (daily/monthly/initial test/nap/single session), we collect and use:

• Sleep information: Sleep score, time to fall asleep, wake-up time, deep sleep duration, light sleep duration, awake duration (collectively "sleep duration"), sleep efficiency, body movements during sleep, out-of-bed duration, out-of-bed frequency, etc.;
• Heart rate information: Heart rate during sleep, average heart rate, heart rate reference values, arrhythmia index changes, fatigue index, recovery index, etc.;
• Respiration information: Respiration rate during sleep, respiration rate reference values, average respiration rate, etc.;
• Snoring information: Snoring frequency, snoring reduction frequency, snoring reduction time points, snoring reduction sensitivity, etc.;
• Stress information: Comprehensive stress index, stress resistance, stress index, autonomic nervous system activity, etc.;
• Heart rate variability (HRV) information: HRV reference values, cardiovascular event risk factors index, nighttime nervous system function output index, cardiovascular event risk index, cardiac autonomic nerve function regulation impairment index, etc.;
• Algorithm information: Apnea frequency, apnea occurrence time, apnea reference values.

We generate sleep reports based on the above information.

2.4.2 Voice Control/Snoring Monitoring/Smart Snoring Intervention Services

• For products with voice control functions, we collect voice information to enable voice control of smart devices.
• As the information source for snoring intervention, snoring monitoring requires collecting voice and timbre information to identify snoring through snoring algorithms and apply device functions.
  • This information is essential for normal device operation. By registering or using our products/services, you consent to our collection and use of such information.

2.5 Other Services

To make our sensor-based additional services more accurate, we collect and use gender, date of birth, height, and weight information:

• If you refuse to provide weight information, you will not be able to use our products and/or services.
• If you refuse to provide gender, date of birth, and height information, the additional services may fail to achieve the intended effects, but this will not affect your use of basic functions.

2.6 Alarm Services

To provide alarm services, we process alarm settings, alarm execution time, and alarm cycle time information. You can decide whether to enable or disable the alarm service through the app’s alarm switch. If you disable the alarm switch, you will not be able to use the alarm service.

2.7 Cloud Care Services

To provide cloud care services, we process:

• Your ID and the ID of the cared-for user;
• Phone numbers, email addresses, and other information of the caregiver and cared-for user provided by you.

You must ensure you have lawfully obtained the consent of the cared-for user to process their personal information. By actively choosing the cloud care service, you represent that you have obtained such consent and agree to our processing of the cared-for user’s information in accordance with this Privacy Policy. If you refuse to provide this information, you will not be able to use the cloud care service.

2.8 Data Analysis Services

To provide better services, we use or collaborate with third-party data service providers to conduct data analysis to predict your preference patterns. If you do not consent to data analysis, you will not be able to enjoy data analysis services or other services associated with them, but this will not affect your use of our other products and services.

2.9 User Sleep Report Interpretation Services

To provide sleep report interpretation services, we collect and use:

• Part of the information from the specific functional scenarios above;
• Usage records of device functions (specific to the functions you actually use).

If you refuse to provide this information, you will not be able to use our sleep report interpretation service (i.e., our sleep butler will not be able to interpret your sleep reports).

2.10 System Permission-Based Services

We collect and use personal information by enabling system permissions for the following products and/or services. If you do not consent to enabling relevant permissions, you will not be able to use our products and/or services normally.

You can view the status of these permissions in your device’s Settings and decide to enable or disable them at any time.

• Enabling a permission means you authorize us to collect and use relevant personal information to provide corresponding services.
• Disabling a permission means you revoke the authorization, and we will no longer collect or use relevant personal information based on that permission, nor will we be able to provide the corresponding service.

Details of our app permission requests and usage:

1. Camera/Camera Permission:
   • Required to scan QR codes for binding your account to smart devices. If disabled, you cannot use our products and services.
   • Optional for taking photos to complete your personal homepage information. If disabled, basic functions are unaffected, but the service may not achieve intended effects.
2. Network Permission:
   • Required for data communication in all products/services. If disabled, you cannot use our products and services.
3. Location Permission:
   • Required for all products/services. If disabled, you cannot use our products and services.
4. Album Permission:
   • Required for all products/services. If disabled, you cannot use our products and services.
5. Microphone Permission:
   • Collected when using app voice functions.
6. Storage Permission:
   • Required to obtain device firmware for product upgrades. If disabled, you cannot upgrade products.
   • Optional for accessing photos, media, or files on your device. If disabled, basic functions are unaffected, but the service may not achieve intended effects.
7. 特别说明
   1. 您知悉我们的产品/服务非医疗器械或医疗服务，我们的数据变化提醒仅供参考，不能作为诊疗依据。
   2. 我们需要特别提醒您的是：由于我们的产品和服务的不同，为您提供的内容也不同，因此具体产品与/或服务的基本和附加功能（包括其收集的您的个人信息类型、范围）也会因产品/服务的内容不同而有所区别， 具体以产品/服务实际提供为准。 除此之外，您理解并同意，我们希望提供给您的产品和服务是完善的，所以我们会不断改进我们的产品和服务，包括技术，这意味着我们可能会经常推出新的业务功能， 可能需要收集新的个人信息或变更个人信息使用目的或方式。如果某一需要收集您的个人信息的功能或产品/服务未能在本隐私政策中予以说明的， 我们会通过更新本隐私政策、页面提示、弹窗等方式另行向您说明该信息收集的目的、内容、使用方式和范围，并为您提供自主选择同意的方式，且在征得您明示同意后收集。
   3. 另外，您充分理解依照法律规定，我们在以下情况下处理您的个人信息无需您的授权同意：
      1. 与国家安全、国防安全直接相关的。
      2. 与刑事侦查、起诉、审判和判决执行等直接相关的。
      3. 为订立、履行个人作为一方当事人的合同所必需，或者按照依法制定的劳动规章制度和依法签订的集体合同实施人力资源管理所必需。
      4. 为履行法定职责或者法定义务所必需。
      5. 从合法公开披露的信息中收集个人信息的，如合法的新闻报道、政府信息公开等渠道。
      6. 为应对突发公共卫生事件，或者紧急情况下为保护自然人的生命健康和财产安全所必需。
      7. 为公共利益实施新闻报道、舆论监督等行为，在合理的范围内处理个人信息。
      8. 个人信息控制者为学术研究机构，出于公共利益开展统计或学术研究所必要，且其对外提供学术研究或描述的结果时，对结果中所包含的个人信息进行去标识化处理的。
      9. 依照《中华人民共和国个人信息保护法》在合理的范围内处理您自行公开或者其他已合法公开的个人信息。
      10. 法律、行政法规规定的其他情形。

3. Special Notes

3.1 Awareness of Non-Medical Nature

You acknowledge that our products/services are not medical devices or medical services. Our data change reminders are for reference only and should not be used as a basis for diagnosis or treatment.

3.2 Variations in Services and Information Collection

• Function-Specific Differences: Due to the diversity of our products and services, the basic and additional functions provided (including the types and scope of personal information collected) may vary by product/service. The actual offerings of each product/service shall prevail.
• Continuous Improvement: We are committed to enhancing our products and services (including technologies). This may involve launching new features, which may require collecting new personal information or changing the purposes/methods of using personal information. If a new function or product/service requiring personal information collection is not described in this Privacy Policy, we will notify you separately via updated policy statements, in-app prompts, pop-ups, etc., explaining the purpose, content, usage, and scope of such collection, and obtain your explicit consent before collecting the information.

3.3 Lawful Processing Without Consent

You fully understand that under the following circumstances, we may process your personal information without your authorization or consent in accordance with laws and regulations:

• Related to national security or defense security.
• Related to criminal investigation, prosecution, trial, or enforcement of judgments.
• Necessary for entering into or performing a contract where you are a party, or for human resources management under legally established labor rules or collective contracts.
• Necessary for fulfilling legal duties or obligations.
• Collected from lawfully publicly disclosed information (e.g., legitimate news reports, government information disclosures).
• Necessary to respond to public health emergencies or protect natural persons’ life, health, or property in urgent situations.
• Processing personal information within a reasonable scope for public interest purposes such as news reporting or public oversight.
• Where the personal information controller is an academic research institution and the processing is necessary for statistical or academic research in the public interest, provided that personal information in research results is de-identified before external disclosure.
